DETAILED TERMS & CONDITIONS

This Terms and Conditions Agreement ("Agreement") is between you ("User") and HealthScout ("Company"), a service of Doodle Buddy Labs LLC, for the HealthScout mobile application ("the App") and website located at healthscout.co ("the Website"). By downloading, installing, or using the App, or by accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. SERVICES AND LIMITATIONS

1.1 Services Provided

HealthScout provides an educational platform that:

  • Connects to Apple Health with your permission

  • Provides informational content about health topics

  • Offers insights based on your health data

  • Helps you understand medical terminology and healthcare options

1.2 Educational Tool Only

HealthScout is an educational tool only and NOT a medical device or service:

  • The App does not diagnose, treat, cure, or prevent any disease or health condition

  • Information provided is for educational purposes only

  • The App is not a substitute for professional medical advice, diagnosis, or treatment

  • Never disregard professional medical advice or delay seeking it because of something you read on HealthScout

1.3 Accuracy and Reliability

While we strive for accuracy and reliability:

  • Health information and medical knowledge evolve constantly

  • The App relies on the accuracy of information provided by you and your healthcare providers through Apple Health

  • We cannot guarantee that all information will be complete, accurate, or up-to-date

  • The App may not capture all relevant health information depending on what is available through your connected healthcare providers

1.4 Website Usage

The HealthScout website provides:

  • General information about our services

  • Marketing materials about the App

  • Access to our Privacy Policy and Terms

  • A contact form for inquiries

  • Links to download the App

The Website does not provide the health data analysis features available in the App. All health-related features require downloading and using the App.

2. USER ACCOUNT AND ELIGIBILITY

2.1 Age Requirement

You must either be 18 years of age or older or be a parent/legal guardian acting on behalf of a minor to use HealthScout. Parents or legal guardians may use the App to manage the health information of their children or dependents.

2.2 Account Security

You are responsible for maintaining the security of your device and account access:

  • Keep your device secure with appropriate passcodes or biometric protection

  • Do not share your account access with others

  • Notify us immediately of any unauthorized access to your account

  • You are responsible for all activities that occur under your account

2.3 Account Termination

We reserve the right to suspend or terminate your access to HealthScout:

  • If you violate these Terms

  • If we suspect fraudulent or abusive activity

  • To comply with legal requirements

  • For extended periods of non-use

  • At our discretion for any reason with reasonable notice

3. PRIVACY AND DATA HANDLING

3.1 Apple Health Data

HealthScout accesses health data from Apple Health only with your explicit permission:

  • You control which types of health data we can access through iOS Settings

  • We use this data only to provide services within the App

  • We do not permanently store your raw Apple Health data on our servers

  • Data remains encrypted on your device according to Apple's security protocols

  • You can revoke access to your health data at any time through your iOS Settings

3.2 Data Storage and Processing

To provide our services:

  • Chat conversations within the App may be stored locally on your device or in your personal CloudKit account if you enable this feature

  • Data is transmitted securely using industry-standard encryption (HTTPS) when processed

  • We process data using AI services that do not use your queries for model training

  • We implement appropriate technical and organizational measures to protect your data

3.3 Privacy Policy

Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains our practices regarding:

  • How we access and use your Apple Health data

  • Our commitment to never permanently store your health data in the cloud

  • How we handle chat history storage and security

  • Analytics data collection and separation from health data

  • Your privacy rights and how to exercise them

3.4 Website Contact Form

When you submit information through our Website contact form:

  • We collect the personal information you provide (name, email, and message content)

  • This information is used solely to respond to your inquiry

  • Your information is securely transmitted and stored

  • We retain this information only as long as necessary to address your inquiry

  • We do not use contact form information for marketing purposes without your consent

  • You can request deletion of your contact form information by emailing privacy@healthscout.co

3.5 User-Generated Data and Responsibility for Data Loss

To use certain features of the App, you may create, enter, or save information locally on your device ("User-Generated Data"). User-Generated Data includes, but is not limited to, your Manual Health Entries, your Chat History, and your saved preferences such as Treatment Discovery Alerts Areas of Interest. You acknowledge and agree to the following regarding all User-Generated Data:

  • Local Storage: All User-Generated Data is stored locally on your personal device.

  • User-Controlled Backup: The App may offer an optional feature to back up this data using your personal Apple iCloud account. This backup process is controlled by you and is subject to Apple's terms and availability. We do not manage or have access to your personal iCloud backup.

  • Sole Responsibility: You are solely responsible for the creation, maintenance, and regular backup of your User-Generated Data. We strongly recommend that you enable iCloud backup for the App and ensure your device is regularly backed up to prevent permanent data loss.

  • No Liability for Loss: HealthScout and Doodle Buddy Labs LLC are not a data storage or backup service. To the maximum extent permitted by law, we shall have no liability for any loss, corruption, destruction, or unavailability of your User-Generated Data, regardless of the cause. This includes, but is not limited to, loss due to software glitches, app updates, device failure, or user error. You assume all risk of data loss for any information you create or enter into the App.

4. SUBSCRIPTION AND BILLING

4.1 Freemium Model

HealthScout operates on a freemium model:

  • Basic features are available for free

  • Premium features require a paid subscription

  • Free and paid features may change over time

4.2 App Store Payments and Subscriptions

All financial transactions are processed exclusively through the Apple App Store:

  • Payment will be charged to your Apple ID account at confirmation of purchase

  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period

  • Your account will be charged for renewal within 24 hours prior to the end of the current period

  • You can manage and cancel your subscription at any time before the renewal date in two easy ways:

4.3 Refunds and Billing Issues

  • All payment processing, refunds, and related customer service are handled exclusively by Apple

  • Refund requests must be submitted directly to Apple according to their terms and policies

  • We do not have the ability to issue refunds or access your payment information

  • For billing problems, disputed charges, or refund requests, please contact Apple Support directly

  • All purchases are subject to Apple's applicable payment and refund policies

5. INTELLECTUAL PROPERTY

5.1 Ownership

All rights, title, and interest in and to the App and teh Website, including all intellectual property rights, remain with the Company:

  • The App and the Website is protected by copyright, trademark, and other laws

  • Our name, logo, product designs, and website content are our trademarks and may not be used without permission

  • Content created by the App based on your health data is for your personal use only

5.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Use the App for your personal, non-commercial purposes

  • Access and use the Website for its intended purposes

  • Both in accordance with these Terms

5.3 Restrictions

You may not:

  • Modify, adapt, translate, reverse engineer, decompile, or disassemble the App or Website

  • Create derivative works based on the App or Website

  • Remove proprietary notices from the App or Website

  • Use the App or Website for any illegal purpose - Interfere with the security or operation of the App or Website

  • Attempt to gain unauthorized access to the App, Website, or their systems

  • Scrape, crawl, or otherwise extract data from the Website without our permission

6. DISCLAIMERS AND WARRANTIES

6.1 Medical Disclaimer

HEALTHSCOUT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

  • Always seek the advice of qualified healthcare providers with any questions you may have regarding medical conditions

  • Never disregard professional medical advice or delay in seeking it because of something you have read on HealthScout

  • If you think you may have a medical emergency, call your doctor or emergency services immediately

  • We explicitly disclaim any responsibility for any decision or action taken by you based on information provided by the App

6.2 "As Is" Provision

THE APP IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, including but not limited to:

  • No warranty that the App will meet your requirements or expectations

  • No warranty regarding the accuracy, reliability, or completeness of information provided

  • No warranty that the App will be error-free, secure, or uninterrupted

  • No warranty regarding the quality of any products, services, information, or materials purchased or obtained through the App

6.3 Technical Limitations

You acknowledge that:

  • The App relies on third-party services including Apple Health and internet connectivity

  • Technical problems or maintenance may temporarily interrupt service

  • Updates may be required from time to time, and older versions may cease to function

  • The App may not be compatible with all devices or operating system versions

7. LIMITATION OF LIABILITY

7.1 Exclusion of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or exemplary damages

  • Loss of profits, revenue, data, goodwill, or other intangible losses

  • Damages relating to your access to, use of, or inability to access or use the App

  • Any conduct or content of any third party on the App

  • Any unauthorized access, use, or alteration of your transmissions or content

  • Health outcomes related to use of the App or decisions made based on information provided by the App

  • Security breaches or data incidents beyond our reasonable control

  • Damage to your device related to downloading or using the App

7.2 Limitation of Liability Amount

In jurisdictions where the exclusion of liability is not permitted, our total liability to you for all claims arising from or relating to these Terms or your use of the App shall not exceed the greater of:

  1. The total fees you paid to use the App during the twelve (12) months immediately preceding the event giving rise to the claim, or

  2. One Hundred United States Dollars (US $100).

This cap does not apply to liability resulting from our willful misconduct, gross negligence, or any violation of applicable privacy or data-protection laws that provides for statutory damages.

7.3 Essential Purpose

The limitations of damages set forth above are fundamental elements of the basis of the bargain between you and the Company. You acknowledge that we would not be able to provide the App without such limitations.

7.4 Assumption of Risk

You acknowledge and agree that your use of the App and any information provided therein is entirely at your own risk. You understand that health information is complex and constantly evolving, and that the AI-powered tools may generate information that is incomplete, inaccurate, or not applicable to your specific health circumstances. You voluntarily assume all risks associated with any actions or decisions you make based on the information provided by the App, and you agree that the Company will have no liability in connection with any such actions or decisions.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of any third-party right, including without limitation any intellectual property right or privacy right

  • Any claim that your use of the App caused damage to a third party

This defense and indemnification obligation will survive termination of these Terms and your use of the App.

9. DISPUTE RESOLUTION

9.1 Binding Arbitration

IMPORTANT: THIS SECTION CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be settled by binding arbitration administered by JAMS under its Comprehensive Arbitration Rules and Procedures.

9.2 Class Action Waiver

YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

9.3 Opt-Out Right

You have the right to opt out of binding arbitration within 30 days of the date you first accepted these Terms by emailing us at legal@healthscout.co with the subject line "Arbitration Opt-Out" and including your name and address.

9.4 Jurisdiction and Venue

Any proceedings will be held in San Diego County, California, and you consent to personal jurisdiction and venue in that location.

10. GENERAL PROVISIONS

10.1 Governing Law

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision.

10.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

10.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of the Company.

10.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the App and supersede all prior agreements and understandings.

10.5 Modifications

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or through the App. Your continued use of the App after such notification constitutes your acceptance of the modified Terms.

11. APPLE-SPECIFIC TERMS

The following terms apply specifically to your use of the HealthScout App downloaded from the Apple App Store:

11.1 Acknowledgment of Parties

You acknowledge that this Agreement is concluded between you and HealthScout, a service of Doodle Buddy Labs LLC, only, and not with Apple Inc. ("Apple"). HealthScout, not Apple, will be solely responsible for the HealthScout App and its content. This Agreement may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.

11.2 Scope of License

The license granted to you for the HealthScout App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may be accessed and used by other accounts associated with your Apple ID via Family Sharing or volume purchasing.

11.3 Maintenance and Support

HealthScout is responsible for providing maintenance and support services for the App as specified in these Terms and to the extent required under applicable law, subject to the limitations and disclaimers set forth in these Terms. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for the HealthScout App.

11.4 Warranty and Refunds

HealthScout's responsibility for product warranties is subject to the disclaimers and limitations set forth in these Terms. To the extent not effectively disclaimed in these Terms, HealthScout is responsible for any product warranties, whether express or implied by law. In the event the HealthScout App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be subject to the limitations of liability set forth in these Terms.

11.5 Product Claims

You acknowledge that HealthScout, not Apple, is responsible for addressing claims by you or any third party relating to the HealthScout App or your possession and/or use of the App, subject to the limitations of liability, disclaimers, and other protections set forth in these Terms, including but not limited to:

  • Product liability claims

  • Any claim that the App fails to conform to any applicable legal or regulatory requirement

  • Claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of the Apple Health framework

This Agreement does not limit HealthScout's liability to you beyond what is permitted by applicable law.

11.6 Intellectual Property Rights

You acknowledge that in the event of any third-party claim that the HealthScout App or your possession and use of the App infringes that third party's intellectual property rights, HealthScout, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

11.7 Legal Compliance Representation

You represent and warrant that:

  • You are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country

  • You are not listed on any U.S. Government list of prohibited or restricted parties

11.9 Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the HealthScout App, including but not limited to your wireless data service agreement when using the App's internet-dependent features.

11.10 Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
